Wolt+ Subscription Terms and Conditions - Bulgaria

These terms and conditions govern your use and purchase of a Wolt+ subscription (“Wolt+” or “Subscription”). Wolt+ is an automatically renewing subscription requiring recurring payments of a subscription fee until cancelled. Wolt+ Subscription grants you access to certain benefits (“Wolt+ Benefits”) on eligible orders placed through Wolt Service for eligible Partners with a minimum subtotal as indicated in the Wolt Service. The Subscription is subject to these Wolt Subscription Terms and Conditions (“Wolt+ Subscription Terms”) and our Wolt Privacy Statement which are incorporated herein by reference. User Terms of Service shall govern anything not specifically covered in the Wolt+ Subscription Terms.

Partner, Order, User, Customer Organization, Wolt and Wolt Service are defined in the User Terms of Service and have the same meaning as defined in the User Terms of Service.

If you have a Wolt for Work Account and/or a Wolt+ Subscription that is granted to you by the Customer Organization (“Corporate Wolt+ Subscription”), these terms and conditions also apply to the Customer Organization with respect to Corporate Wolt+ Subscription.

This also means that Wolt Oy will assist you with possible refunds, complaints and other claims related to your transactions in the Wolt Service. You may thus contact Wolt Oy directly at the contact details provided above in case of any dispute or claim related to the Wolt Service with Wolt and the Partners.

1. WHAT IS WOLT+?

  • Wolt+ Benefits are applicable for eligible orders placed through Wolt Service for eligible Partners with a minimum order value as indicated through the Wolt Service. You will be presented with the applicable Wolt+ Benefits when signing up to the Subscription.

  • Eligible Partners are marked with the W+ logo in the Wolt Service. Please note that eligible Partners may vary depending on your selected delivery address. Maximum delivery range restrictions apply. If you did not enable location tracking, or did not enter a delivery address, eligible Partners shall be displayed according to the delivery ranges in your selected city center.

  • Minimum order values may vary from time to time and may differ between the eligible Partners. Wolt reserves the right to change the minimum order value for any Partner at any time.

  • The Subscription is offered for a monthly or yearly subscription fee payable at the start of the relevant subscription period (“Subscription Fee”)

  • The Subscription will automatically renew after the monthly or yearly payment period unless you cancel the Subscription in accordance with section 4 below. You can cancel your Subscription at any time in your user profile in the Wolt Service.

  • The Subscription and Wolt+ Benefits are limited to the country in which you purchase the Subscription (“Subscription Country”). If you travel outside of your Subscription Country, your Wolt+ Benefits will not apply to any purchases made while outside of your Subscription Country.

  • The Subscription is for personal use and only consumers are eligible to purchase Wolt+, unless otherwise indicated in these Wolt+ Subscription Terms.

1.1. By buying or by using the Subscription you agree to these Wolt+ Subscription Terms and the specific terms detailed in the Wolt Service about the Subscription. You also agree to have your payment method charged automatically monthly or yearly, depending on your selected Subscription term, in every billing cycle on a recurring basis during the term of your Subscription. The Subscription and Wolt+ Benefits are subject to change so please make sure you check the current details of the Subscription in the Wolt Service.

1.2. Eligible Partners are Partners who participate in the Wolt+ program. Wolt cannot guarantee the eligibility of a certain Partner and reserves the right to change whether Wolt+ Benefits are redeemable from a certain Partner at any time with or without notice. Wolt+ Benefits are subject to geographic availability, and fees such as service fee, taxes or other fees may apply to your Order.

1.3. Additional details of the Subscription are available in the checkout before you purchase the Subscription in the Wolt Service and will include important terms, such as where and when the Wolt Subscription may be used, the available Wolt+ Benefits, the cost and the billing interval of the Wolt Subscription. Please review the details of the Wolt Subscription in the Wolt Service before purchase.

1.4. You are able to view and manage your Subscription by tapping the tab Wolt+ in your user profile in the Wolt Service. You can see your Subscription Country and manage the settings including payment method details, Subscription end date, next payment date through your user profile.

1.5. If you want to activate your Corporate Wolt+ Subscription or change your current Wolt+ subscription to Corporate Wolt+ Subscription provided by the Customer Organization, you must have a Wolt for Work Account and change the payment method of the Wolt+ Subscription on the Wolt App, as per the relevant instructions provided by Wolt and/or Customer Organization. If you are changing your current Wolt+ Subscription to Corporate Wolt+ Subscription, the change will only take effect by the end of your then current subscription period.

1.6. By taking Corporate Wolt+ Subscription into use, the Customer Organization understands and acknowledges that it has full responsibility for its employer obligations and tax compliance, including tax implications to its employees that use the Corporate Wolt+ feature. Wolt takes no responsibility for any tax or other obligations that concern the Customer Organization and its employees.

2. PURCHASING WOLT+ AND FREQUENCY OF CHARGES

2.1. You can purchase Wolt+ directly in the Wolt Service by tapping the Get Wolt+ tab or start your free trial as applicable in the Wolt Service.

2.1.1. The technical steps the User shall follow to activate the Wolt+ Subscription are as follows:

  • logging into the User account;

  • purchasing Wolt+ directly in the Wolt Service or starting your free trial as applicable in the Wolt Service by clicking on the Wolt+ banner on the opening screen of Wolt (app and website), you will be taken to the registration page;

  • clicking on the button called "Get Wolt+" on the registration page;

  • entering your payment details;

  • accepting the General Terms and Conditions by clicking through the checkbox;

  • clicking the button "Subscription with obligation to pay" to complete the process.

  • Wolt provides a confirmation of the Subcscription without undue delay on your e-mail. After that, the Subscription is activated. The purchase of the Subscription is considered concluded from the moment of receiving the confirmation of the Subscription.

The click through for accepting of the Terms and Conditions shall be deemed with legal effect equivalent to a handwritten acceptance and signing of the Terms and Conditions.

2.1.2. You can see details of your Subscription and applicable Wolt+ Benefits, and choose the primary payment method for the Subscription Fee before confirming the purchase of Wolt+. Before subscribing all relevant data can be seen on the checkout page. Wolt thus provides the possibility for you to identify and correct input errors through efficient and accessible technical tools prior to subscribing to Wolt+.

2.1.3. The contract for the purchase of the Subscription can be concluded in English or Bulgarian.

2.1.4. The details of your Subscription are saved to the User’s profile, thus they are accessible later on as well. Otherwise, Wolt does not file or register such contracts.

2.2. You can purchase the Subscription for a month or a year and you will be billed in advance on the basis of your selected subscription period. When you purchase the Subscription, you'll be charged the Subscription Fee for your first billing cycle on the date of purchase, which activates Wolt+ for the term detailed in your user profile, unless you were eligible for a free trial in which case the first payment occurs the day after the end of the free trial period.

2.3. The billing cycle is based on the first payment date of the Subscription Fee. The primary payment method you selected when purchasing the Subscription will be charged automatically in accordance with the payment cycle. You can change your primary payment method in the Wolt+ tab in your user profile. If you do not want Wolt Subscription to automatically renew, you can cancel your subscription in accordance with Section 4 below. If you have a Corporate Wolt+ Subscription, your billing cycle will be in accordance with the terms of Customer Organization and your Corporate Wolt+ Subscription may also be cancelled by the Customer Organization.

2.4. In order to prevent any interruption to your use of the Subscription, you authorize Wolt to charge the subscription fee from any payment method saved to your Wolt account in case your primary payment method fails. However, Wolt is under no obligation to use this option. It is your responsibility to keep your payment method information up to date.

2.5. If we are unable to process your Subscription Fee payment, we will ask you to select a different or add a new payment method. If your payment fails during the recurring payment cycle, we reserve the right to terminate your Subscription automatically or to charge the Subscription Fee after a pre-defined period retroactively calculated from the original payment cycle start date.

3. FREE TRIALS AND THIRD-PARTY PARTNERSHIPS

3.1. We and/or third parties authorized by Wolt (“Authorized Partners”) may offer some Users a free or other promotional subscriptions to the Wolt+ Subscription. Free trials or promotional subscriptions are subject to these Wolt+ Subscription Terms except as otherwise stated in your offer. Free trials may be limited in Wolt’s sole discretion, including based on eligibility or duration of free trial. If you are offered a free trial, you are required to add a payment method for the Subscription before starting the free trial. Certain limitations may exist with respect to combining a free trial with any other offers. Only one free trial period or other promotional subscription is available per User.

3.2. We will automatically renew your Subscription after the free trial and charge the payment method you chose when starting the free trial. By providing payment method details you agree that at the end of the applicable free trial or promotional subscription period, your Subscription will automatically renew and you will be charged the Subscription Fee stated in your Offer. You can cancel the Subscription at any time through your user settings in the Wolt Service. If the Subscription is ever terminated for any reason, you shall not be eligible for a new free trial on any subsequent Subscription.

3.3. Promotional subscriptions for Wolt+ that are offered or provided by Authorized Partners may be subject to additional terms and conditions, which will be presented at the time of the offer by the Authorized Partner or by Wolt as applicable.

4. CANCELLING YOUR WOLT+ SUBSCRIPTION

4.1. You can cancel your Subscription in the course of the day preceding the renewal date of your Subscription, or as agreed separately with the Customer Organization. You can cancel your subscription in the “manage membership” tab in your user profile in the Wolt Service, where you can also see the next payment date.

4.2. If you cancel your Subscription, you will still have access to Wolt+ Benefits until the end of the ongoing payment cycle that you have paid for. All monthly or yearly Subscription Fee payments are non-refundable and non-transferable and will not be refunded for any cancellation initiated during a billing cycle.

4.3. If you participated in a free trial or other promotional subscription period for Wolt+, you may cancel within the first 48 hours of your first paid Subscription period and receive a full refund of your Subscription Fee (as applicable) by contacting Wolt’s customer support.

4.4. For both monthly and annual subscribers, if you cancel your Subscription within the first 48 hours of your first Subscription period and have not placed a Wolt+ -eligible order during that period, Wolt may, in its sole discretion, refund your Wolt+ fee. Please contact Wolt’s customer support for such cancellation request.

5. WITHDRAWAL RIGHT

5.1. You have the right to withdraw from the Subscription without giving any reason by notifying Wolt within fourteen (14) days of purchasing the Subscription. To exercise your right of withdrawal, you must clearly and expressly notify us of your decision to withdraw from the Subscription by email at support@wolt.com or by postal mail . You can use the model withdrawal form – (attachement No. 1 to these Wolt+ Subscription Terms), but it is not mandatory.

To meet the withdrawal deadline, it is sufficient to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

5.2 If you withdraw from the Subscription, we will return the Subscription Fee to you within fourteen (14) days of receiving the withdrawal notice, and cancel your Subscription with immediate effect. We will perform the refund using the same payment method you used when purchasing the Subscription, unless you have expressly agreed otherwise. In any case, this refund will not be associated with any costs for the consumer.

5.3 However, if you have requested the Subscription to be performed before the end of the withdrawal period, you must pay us a reasonable compensation for the services performed to fulfil the contract by the time the withdrawal notice is made. Wolt will refund you the Subscription fee on a pro-rata basis, based on your use of the Subscription and Wolt+ Benefits up to the date of the withdrawal.

5.4. Please note that if you are eligible for a free trial, your right of withdrawal is included in the free trial period, provided that such period is 14 days at minimum, and you will not have a right to withdraw from the Subscription after you have paid the first Subscription Fee, unless otherwise provided in these Wolt+ Subscription Terms. For the avoidance of doubt, these provisions apply only for the first purchase of the Subscription, and they do not apply to any automatic renewal of the Subscription.

6. CHANGES TO THE SUBSCRIPTION

6.1. Wolt reserves the right to modify or stop offering the Subscription or change Subscription Fee, applicable Wolt+ Benefits or these Wolt+ Subscription Terms at any time in its sole discretion. However, we will not make changes to the Subscription, Wolt+ Subscription Terms or Wolt+ Benefits that have a notable adverse affect on you without giving a minimum of a 14-day prior written notice. Changes increasing your Subscription Fee are given a 45-day prior written notice. The changes will enter into force automatically after the notice period. If you do not agree with the changes, you can cancel your Subscription in accordance with the instructions in Section 4 above.

6.2. Wolt is entitled to terminate the Subscription of a User with immediate effect if: (i) the User abuses the Wolt Service or Subscription or causes any harm or detriment to the use of the Wolt Service or the Partners or Wolt or Wolt’s employees; (ii) Wolt has reasonable belief of fraudulent acts by the User when using the Subscription, or (iii) the User otherwise fails to comply with the obligations arising from these Wolt+ Subscription Terms, User Terms of Service or applicable laws. Wolt reserves the right to withhold already paid Subscription charges if the Subscription is terminated due to a circumstance defined in this section.

7. PROCESSING OF PERSONAL DATA

7.1. Wolt Privacy Statementdescribes our processing of personal data in relation to the Subscription.

7.2. We will not use or collect any additional personal data from you due to the Subscription, except the details of your Subscription plan, including the price, payment method, validity time, benefits included and whether a minimum order value and Delivery Range applies.

7.3. Wolt processes the above personal data to be able to offer the Subscription to you under the contract between you and Wolt. We use the data to enable you to use the Wolt+ Benefits of your Subscription and show the status and handle your payments of the Subscription. If you contact our customer service, we will use the information provided by you to answer your questions or solve your complaint.

7.4. Wolt processes the personal data to perform our contractual obligations towards you and to comply with legal obligations.

8. DEFECTS AND COMPLAINTS

8.1. Please contact support@wolt.com without undue delay in case you notice any unauthorized charges on your Subscription payment method or in case you have a complaint with the Subscription.

8.2. The Subscription and/or any of its features may be unavailable, inaccurate or interrupted from time to time for a variety of reasons and Wolt is not responsible for such unavailability. For the avoidance of doubt certain features or Wolt+ Benefits available to any User at a specific time, may not be available to all Users at the same time or at all times, and certain features or Wolt+ Benefits may only be available in the latest version of the Wolt App.

8.3. Wolt+ and all the information accessible through it are provided for information purposes only on an "as is" and "as available" basis. We make no warranties, representations, or guarantees of any kind, express or implied, including but not limited to, accuracy or completeness of the Subscription or the availability thereof.

8.4. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to, implied warranties or merchantability and fitness for a particular purpose of the Subscription.

8.5. Statutory guarantee of conformity:

If you are a consumer under the meaning of the law, please note that under the Bulgarian Digital Content and Digital Services and Sale of Goods Act there is a legal guarantee of conformity of products, digital content and digital services.

Under the Bulgarian consumer protection legislation and subject to the conditions set out in the consumer protection legislation, in the event of non-conformity of the digital content or digital service, the consumer has the right to: (i) make a complaint, requesting the trader to bring the digital content or digital service into conformity; (ii) obtain a proportionate price reduction, or (iii) terminate the contract under the conditions set out in the legislation.

The consumer has the right to make a complaint by requesting the trader to bring the digital content or digital service into conformity, unless this proves to be impossible or would impose disproportionate costs on the trader, taking into account all the circumstances of the case. In such case, the consumer may request for a proportionate price reduction or terminate the contract under the conditions set out in the legislation.

Moreover, under consumer protection legislation and subject to the terms and conditions of the legislation, the consumer may request the trader to provide the digital content or digital service where the digital content or digital service is not provided by the trader without undue delay after the conclusion of the contract.

A claim under the statutory guarantee of conformity regarding digital content or a digital service may be brought within: (i) two years from the date of the provision of the digital content or digital service where the contract provides for a single provision or a series of separate acts of provision of the digital content or digital service; (ii) the period of time during which the digital content or digital service is to be provided under the contract where the contract provides for the continuous provision of the digital content or digital service within a specified period of time;
